These Terms of Service and End User License Agreement, together with any policies or additional terms incorporated by reference, are referred to as the “Terms.” They are a legally binding agreement between you and The Pathlight Project, Inc., doing business as Pathlight (“Pathlight,” “we,” “us,” or “our”). They govern your access to and use of the PATH application, Pathlight websites, related software, features, content, and services that link to these Terms, collectively, the “Service.”
Please read these Terms carefully. By creating an account, accessing the Service, connecting an account or integration, selecting “I Agree,” or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.
1.About PATH
PATH is an AI-powered, voice-based assistant designed to help users, including blind and low-vision users, complete digital tasks using natural speech and other supported inputs.
Depending on the features available to you, PATH may help you:
- Read, search, summarize, draft, send, reply to, forward, star, archive, move, organize, or otherwise manage email in Gmail, Outlook, or iCloud Mail;
- Review, create, change, or delete Google Calendar and Outlook Calendar events;
- Look up the people you ask about, to resolve recipients (Gmail and Outlook);
- Create reminders or follow-up tasks;
- Answer general informational questions;
- Provide weather or location-aware information based on a location you enter, share, or authorize PATH to access; and
- Perform other supported digital tasks.
Features may vary based on your device, operating system, location, account type, app version, connected provider, provider permissions, organizational restrictions, and product availability. Pathlight may add, modify, restrict, suspend, or remove features at any time. Pathlight may add, change, or remove supported integrations over time; availability will be reflected in the app and current product documentation.
2.Eligibility
You must be at least 13 years old to use the Service.
If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian, who must review and agree to these Terms on your behalf.
The Service is not directed to children under 13. You may not create an account or use the Service if you are under 13.
By using the Service, you represent that:
- You meet the eligibility requirements above;
- You have the legal capacity to agree to these Terms;
- You are not prohibited from using the Service under applicable law; and
- The information you provide to Pathlight is accurate and complete.
If you use the Service on behalf of a company, school, rehabilitation center, nonprofit, employer, or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes both you and the organization.
3.Your PATH Account
You may need to create a PATH account to use some or all of the Service. You are responsible for:
- Providing accurate account information;
- Maintaining the security of your device and account;
- Keeping login methods and authentication information secure;
- Preventing unauthorized use of your account;
- Promptly notifying us if you suspect unauthorized access; and
- All activity conducted through your account, except to the extent caused by Pathlight’s breach of these Terms or applicable law.
You may not create an account using false information, impersonate another person, or create an account for another person without authorization. We may require identity, account, or authorization verification before allowing access to certain features or responding to account-related requests.
4.Signing In Is Separate From Connecting an Account
You may sign into PATH using an Apple, Google, or Microsoft identity through our authentication provider, or another supported authentication method.
Signing into PATH creates or authenticates your PATH account. It does not, by itself, give PATH permission to access your email, calendar, contacts, or other connected-account content. Using a Microsoft or Apple identity to sign in does not connect a Microsoft or Apple mailbox or calendar to PATH.
You must separately authorize each integration. The authorization screen presented by the applicable provider will describe the permissions being requested.
5.Connected Services
“Connected Services” means third-party accounts, applications, platforms, or services that you authorize PATH to access or interact with.
Supported Connected Services currently include:
- Gmail and Google Calendar;
- Google Contacts (read-only) and other supported Google services used to complete the features you request;
- Outlook Mail and Outlook Calendar (including Microsoft 365 mailboxes), via Microsoft Graph;
- Microsoft People (read-only), used to resolve the recipients you name; and
- Apple iCloud Mail (email only), connected with an Apple app-specific password.
Connecting Outlook authorizes PATH to access supported Microsoft email, calendar, and recipient-lookup data within the permissions you grant. iCloud Mail connects email only; iCloud Calendar and Apple Contacts are not connected. Pathlight may add, change, or remove supported Connected Services over time; current availability is reflected in the app and current product documentation.
iCloud Mail requires an Apple app-specific password that you create in your Apple Account — not your normal Apple Account password. You are responsible for creating and maintaining that app-specific password, for entering it only into PATH, and you may revoke it at any time in your Apple Account settings. Do not share your ordinary Apple Account password with PATH.
You authorize Pathlight to access, process, retrieve, and transmit information through a Connected Service only within the permissions you grant and as necessary to provide the features you request.
You represent that:
- You own each Connected Service account you connect or are authorized to use and control it;
- You have authority to permit PATH to access and act through that account;
- Your use of the Connected Service through PATH complies with the provider’s terms and policies; and
- You will not connect another person’s account or organizational account without appropriate authorization.
Google, Microsoft, an employer, a school, or another account administrator may limit, review, suspend, or revoke your access to a Connected Service. Pathlight is not responsible for restrictions imposed by a provider or organizational administrator.
You may disconnect a Connected Service through available PATH settings or by contacting Pathlight. Disconnecting in PATH removes the access (or, for iCloud Mail, the app-specific password) that Pathlight stores for your account. Disconnecting in PATH does not by itself revoke the authorization on the provider's side; to fully remove Pathlight's access, use the provider's account-security controls — your Google Account's third-party access settings, your Microsoft Account's app permissions, or revoking the app-specific password in your Apple Account settings. Disconnecting a Connected Service may prevent related features from working.
6.Google User Data
If you connect a Google account, Pathlight's access, use, storage, and transfer of information received from Google APIs will comply with the Google API Services User Data Policy, including the Limited Use requirements.
Pathlight uses Google user data only to provide or improve user-facing features that you authorize. Pathlight does not:
- Sell Google user data;
- Use Google user data for advertising;
- Transfer Google user data except as permitted by Google’s policies;
- Allow humans to access Google user data except in limited permitted circumstances; or
- Use Google Workspace or Gmail data to train or improve a general-purpose AI model.

7.Voice Commands and Instructions
PATH may process voice commands, speech-to-text transcripts, text commands, corrections, interruptions, cancellations, and follow-up instructions.
You are responsible for the instructions submitted through your account. Before authorizing a consequential action, you should confirm that PATH correctly understood:
- The requested action;
- The intended account;
- The recipient or recipients;
- The message, subject, or attachment;
- The relevant email or thread;
- The event date, time, location, and attendees;
- Whether an instruction is a reply, reply-all, or new communication; and
- Any other material details.
Background noise, speech-recognition errors, device problems, ambiguous language, latency, interruptions, or other factors may cause PATH to misunderstand an instruction.
8.Confirmations and Account Actions
PATH is designed to request confirmation before sending communications or taking certain consequential actions. These actions may include:
- Sending a new email;
- Replying to or replying-all to an email;
- Forwarding an email;
- Moving or deleting certain emails;
- Marking an email as spam;
- Creating, changing, or deleting a calendar event;
- Adding or notifying attendees;
- Taking an action that affects a third party; or
- Making another meaningful change to a Connected Service.
PATH may also ask a clarifying question if multiple contacts, accounts, messages, threads, events, dates, or interpretations match your request. You authorize an action when you provide the requested confirmation or otherwise clearly instruct PATH to proceed.
Confirmation features reduce risk but cannot prevent every error. You remain responsible for reviewing important details before authorizing an action.
9.AI-Generated Outputs and Limitations
PATH uses artificial intelligence and automated systems to interpret commands, retrieve information, summarize content, draft communications, classify information, and generate responses.
AI-generated output may be inaccurate, incomplete, misleading, offensive, outdated, or inappropriate. PATH may misunderstand your speech or intent; omit important details from a summary; generate incorrect information; select the wrong contact, account, email, thread, date, time, or event; draft language that does not reflect your intended tone or meaning; misclassify an email or task; provide outdated or incomplete information; fail to complete a requested action; or state that an action succeeded when additional verification is appropriate.
You should independently review and verify important outputs and actions. PATH output is provided for general assistance and convenience. It is not a substitute for independent judgment or qualified professional advice.
10.Weather, Location, and General Information
Weather
Weather conditions and forecasts can change rapidly. Weather information may be delayed, approximate, incomplete, or inaccurate. Do not rely solely on PATH for severe-weather warnings, evacuation decisions, emergency preparation, or another safety-critical decision.
Location Information
PATH may use:
- A location you state in a command;
- A location saved in your preferences;
- Approximate device or network location; or
- Precise device location, if you grant permission.
Location results may be inaccurate because of device settings, poor signal, provider errors, outdated data, or other factors. You may decline or revoke device-location permission in iOS Settings. Some location-related features may not work without location access.
General Information
General answers may contain errors or reflect information that has changed. PATH does not guarantee that general information is current, complete, or suitable for your circumstances.
11.No Emergency or Safety-Critical Use
PATH is not an emergency service and cannot contact or replace 911, emergency responders, medical personnel, law enforcement, crisis services, or another emergency provider unless a specific feature expressly states otherwise.
Do not rely on PATH as your only method for:
- Emergency communication;
- Physical navigation;
- Crossing streets or avoiding physical hazards;
- Determining whether an environment or route is safe;
- Medical diagnosis or treatment;
- Medication decisions;
- Legal compliance or deadlines;
- Financial, investment, tax, or banking decisions;
- Severe-weather or evacuation decisions; or
- Any situation in which an error or delay could cause death, personal injury, loss of liberty, significant financial loss, or serious property damage.
PATH is not a replacement for a white cane, guide dog, orientation and mobility training, screen reader, emergency alert system, trained professional, or other established safety tool.
12.User Content
“User Content” means information, communications, commands, materials, and data that you submit, connect, transmit, retrieve, or make available through the Service. User Content may include emails, calendar information, contacts, voice commands, transcripts, preferences, and feedback.
As between you and Pathlight, you retain your ownership rights in your User Content.
You grant Pathlight and its authorized service providers a limited, nonexclusive, worldwide, royalty-free license to host, receive, process, transmit, reproduce, format, summarize, retrieve, index, cache, and otherwise use User Content solely as reasonably necessary to:
- Provide the features you request;
- Operate, personalize, secure, maintain, troubleshoot, and support the Service;
- Improve user-facing PATH functionality;
- Prevent fraud, abuse, or security incidents;
- Comply with law; and
- Carry out the practices described in the Privacy Policy.
This license does not give Pathlight the right to sell your User Content or use connected-account content for advertising. This license ends when the relevant User Content is deleted from active Pathlight systems, except to the extent information remains in temporary backups, must be retained for legal or security purposes, has been de-identified, or remains with a third-party provider or recipient. Google user data remains subject to the additional restrictions stated in Section 6.
13.Content Sent to Other People
When you use PATH to send an email, invite an attendee, forward content, or otherwise communicate with another person, the content may be delivered to and retained by the recipient, the recipient's email or calendar provider, your connected provider, your employer, school, or organization, other members of an email thread or calendar event, or other third parties involved in the communication.
Deleting your PATH account or disconnecting an integration does not retract an email, undo an invitation, remove information from a recipient's account, or require a third party to delete information already received.
14.Privacy
Our Privacy Policy explains how Pathlight collects, uses, processes, stores, shares, retains, and protects information. It is incorporated into these Terms by reference. By using the Service, you acknowledge that you have reviewed the Privacy Policy. If these Terms conflict with the Privacy Policy regarding how personal information is handled, the Privacy Policy controls regarding that personal information.
15.Feedback and Product Research
You may provide suggestions, feature ideas, bug reports, accessibility feedback, interview responses, observations, or other feedback about the Service, collectively, “Feedback.”
Unless a separate written agreement says otherwise, you grant Pathlight a perpetual, irrevocable, worldwide, sublicensable, transferable, royalty-free right to use, reproduce, modify, distribute, commercialize, and otherwise use Feedback without restriction or compensation to you.
Feedback does not include personal email, calendar, contact, or connected-account content merely because PATH processes that content. Pathlight will not publicly identify you as a tester, customer, or source of Feedback without your permission. Separate testing, research, confidentiality, compensation, or participation terms may apply to a particular program. If separate signed terms conflict with these Terms regarding that program, the separate signed terms control for that conflict.
16.Acceptable Use
You may use the Service only for lawful, authorized purposes. You may not use or attempt to use the Service to:
- Violate a law, regulation, court order, or another person’s rights;
- Access or control an account without authorization;
- Impersonate another person or misrepresent your identity or authority;
- Send spam, scams, fraudulent messages, deceptive solicitations, or unlawful marketing communications;
- Harass, threaten, stalk, defame, exploit, or harm another person;
- Create, distribute, or facilitate malware, phishing, credential theft, or malicious code;
- Obtain or disclose private information without authorization;
- Infringe intellectual-property, privacy, publicity, contractual, or other rights;
- Circumvent security, authentication, usage limits, safeguards, confirmations, or access controls;
- Probe, scan, test, or exploit a vulnerability without written authorization;
- Interfere with or disrupt the Service or another user’s access;
- Place an unreasonable load on Pathlight systems;
- Use automated systems to scrape, harvest, or extract information except through an interface expressly authorized by Pathlight;
- Reverse engineer, decompile, disassemble, or attempt to derive source code, except to the limited extent applicable law expressly permits;
- Resell, sublicense, rent, lease, or provide the Service to others without written authorization;
- Use the Service to make unlawful or fully automated high-impact decisions about another person;
- Misrepresent AI-generated content as human-generated where disclosure is legally required; or
- Encourage or assist another person in doing any of the above.
We may investigate suspected misuse and may suspend or terminate access where reasonably necessary.
17.Limited License
Subject to your compliance with these Terms, Pathlight grants you a limited, personal, revocable, nonexclusive, nontransferable, nonsublicensable license to install and use the Service on devices you own or control for its intended purposes.
This license does not transfer ownership of any part of the Service to you. You may not copy, modify, distribute, sell, lease, create derivative works from, or exploit the Service except as expressly permitted in these Terms or by applicable law.
18.Pathlight Intellectual Property
The Service, including its software, source and object code, interface, workflows, prompts, models, orchestration methods, documentation, designs, sounds, graphics, branding, logos, trademarks, and other materials, is owned by or licensed to Pathlight and is protected by intellectual-property laws.
Except for the limited license granted in Section 17, Pathlight and its licensors reserve all rights in the Service. “Pathlight,” “PATH,” associated logos, and related branding may not be used without prior written permission.
19.Third-Party Services and Content
The Service depends on third-party products and services, including email and calendar providers, cloud hosting, authentication, databases, AI models, speech-to-text, text-to-speech, analytics, error monitoring, weather, and location providers.
Third-party products and services are governed by their own terms and privacy policies. You must comply with all applicable third-party terms. Pathlight does not control and is not responsible for:
- A third-party outage, delay, error, or security incident;
- The accuracy or availability of third-party information;
- A provider’s decision to change, restrict, suspend, or discontinue an API or feature;
- A provider’s rejection or reversal of an action;
- Restrictions applied by an employer, school, or administrator;
- Content, products, or services supplied by a third party; or
- Charges imposed by your mobile carrier, internet provider, account provider, or another third party.
Links or references to third-party services do not imply Pathlight's endorsement of them.
20.Private Testing, Preview, and Pilot Programs
Pathlight may separately offer private testing, preview, or pilot versions of PATH to selected users. Those versions may contain unfinished features and may be subject to additional terms. The availability of a private testing program does not mean that every public version of Pathlight is a beta product.
If you participate in a private testing, preview, or pilot program, that version may:
- Contain bugs or produce inaccurate results;
- Change materially, be incomplete, or be removed;
- Operate slowly or fail without warning; or
- Never become generally available.
You should maintain independent access to your email, calendar, contacts, and other important information, and you should not use a pre-release version as the sole means of completing an urgent or consequential task. We may place usage, account, feature, geographic, or participant limits on these programs and may end or modify them at any time. Participation may also be governed by a separate Pilot Participation Agreement.
21.Updates and Availability
Pathlight may provide updates, patches, improvements, or new versions of the Service. Some updates may be required to continue using the Service.
We do not guarantee that:
- The Service will always be available;
- The Service will work on every device or operating-system version;
- Every feature will remain available;
- Every Connected Service will remain supported;
- Data will always synchronize correctly;
- Errors will be corrected; or
- The Service will meet every user’s accessibility needs.
We may suspend the Service for maintenance, security, legal compliance, provider changes, or operational reasons.
22.Fees, Subscriptions, and Purchases
Some features may currently be offered without charge. Pathlight may introduce paid features, subscriptions, usage limits, or other purchase options. Before charging you, Pathlight or the applicable app-store or payment provider will display the price and material purchase terms.
If you purchase a subscription:
- The billing period and price will be disclosed before purchase;
- The subscription may automatically renew unless canceled before the applicable renewal date;
- The payment provider may charge your selected payment method;
- You are responsible for applicable taxes;
- You may cancel through the platform or method through which you subscribed;
- Cancellation generally takes effect at the end of the current paid billing period unless otherwise stated or required by law; and
- Refunds are governed by the applicable purchase terms, payment provider rules, and law.
Purchases made through Apple are also subject to Apple's purchase and subscription terms. Purchases made through another platform are subject to that platform's applicable terms.
23.Account Suspension and Termination
You may stop using the Service at any time.
You may request account deletion from within the PATH app or by contacting pathlightproj@gmail.com. See our account deletion page for details.
Pathlight may suspend, limit, or terminate your access if:
- You violate these Terms;
- You create a security, legal, or operational risk;
- Your use appears fraudulent, abusive, or unauthorized;
- A Connected Service requires suspension;
- We are required to do so by law;
- You fail to pay an applicable fee;
- Your account has been inactive for an extended period after appropriate notice, where required; or
- We discontinue the Service.
Where reasonable, we will provide notice before termination. We may suspend access immediately where necessary to address security, fraud, abuse, legal, or safety risks. Upon termination, your license to use the Service ends, connected features may stop working, certain information may be deleted or de-identified as described in the Privacy Policy, and provisions that by their nature should survive will remain in effect. Termination does not undo actions already completed through a Connected Service.
24.Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND.
PATHLIGHT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
PATHLIGHT DOES NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, UNINTERRUPTED, OR ERROR-FREE; THAT PATH WILL UNDERSTAND OR COMPLETE EVERY COMMAND; THAT AN EMAIL, EVENT, REMINDER, OR OTHER ACTION WILL BE CREATED, DELIVERED, RECEIVED, OR SYNCHRONIZED CORRECTLY; THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR APPROPRIATE; OR THAT INFORMATION WILL NEVER BE LOST, CORRUPTED, OR ACCESSED WITHOUT AUTHORIZATION.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
25.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PATHLIGHT AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, COMMUNICATIONS, OR USE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHLIGHT'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID PATHLIGHT FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS.
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF PATHLIGHT WAS ADVISED THAT A LOSS WAS POSSIBLE. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.
26.Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Pathlight and its members, managers, officers, employees, contractors, affiliates, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising out of or relating to:
- Your unlawful or unauthorized use of the Service;
- Your violation of these Terms;
- Your violation of a third party’s rights;
- User Content or instructions you provide;
- Your unauthorized connection or use of another person’s account;
- Communications or actions you direct PATH to complete; or
- Your fraud, willful misconduct, or misuse of the Service.
This section does not require a consumer to indemnify Pathlight to the extent prohibited by applicable law.
27.Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Before filing a formal claim, you and Pathlight agree to attempt to resolve the dispute informally. The party raising the dispute must send written notice describing the issue and requested resolution. Notices to Pathlight must be sent to:

The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of notice. If the dispute is not resolved, and unless applicable law requires otherwise, exclusive jurisdiction and venue will lie in the state and federal courts located in New Castle County, Delaware.
These Terms do not currently require mandatory arbitration or waive participation in a class action.
28.Export and Sanctions Compliance
You may not use, export, re-export, download, or transfer the Service in violation of United States export-control, sanctions, or trade laws. You represent that you are not located in a country or region subject to a United States Government embargo or designated as supporting terrorism, and that you are not listed on a United States Government list of prohibited or restricted parties.
29.Additional Terms for Apple Users
This section applies if you download, access, or use the PATH application on an Apple-branded product.
Acknowledgment
These Terms are between you and The Pathlight Project, Inc., not Apple Inc. Pathlight, not Apple, is solely responsible for the PATH application and its content.
Scope of License
Your license to use the PATH application is limited to a nontransferable license to use the application on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable usage rules.
Maintenance and Support
Pathlight, not Apple, is responsible for providing any maintenance or support for the PATH application. Apple has no obligation to provide maintenance or support.
Warranty
To the extent a warranty cannot legally be disclaimed, Pathlight is responsible for the applicable warranty. If the PATH application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the application.
Claims
Pathlight, not Apple, is responsible for addressing product-liability claims, claims that the application fails to satisfy a legal or regulatory requirement, intellectual-property infringement claims, and claims under consumer-protection or similar law relating to the PATH application.

Apple as Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to the PATH application, and upon your acceptance Apple has the right to enforce the applicable Terms against you as a third-party beneficiary.
30.Changes to These Terms
Pathlight may update these Terms from time to time. If we make a material change, we will provide notice through the Service, website, email, or another reasonable method before the change takes effect, where required by law. The updated Terms will state their effective date. Your continued use of the Service after updated Terms take effect constitutes acceptance, except where applicable law requires additional consent.
31.Electronic Communications
You agree that Pathlight may provide notices, disclosures, agreements, and other communications electronically, including through email, the application, or the Pathlight website. You are responsible for keeping your contact information current. Electronic communications satisfy any legal requirement that a communication be in writing, except where applicable law requires another method.
32.Assignment
You may not assign or transfer these Terms or your account without Pathlight's prior written consent. Pathlight may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, change of control, or operation of law, subject to applicable privacy and notice requirements.
33.Severability
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
34.No Waiver
A failure by Pathlight to enforce a provision of these Terms is not a waiver of its right to do so later. A waiver is effective only if it is in writing and signed by an authorized representative of Pathlight.
35.Entire Agreement
These Terms, the Privacy Policy, and any applicable additional written terms constitute the entire agreement between you and Pathlight concerning the Service and replace prior or contemporaneous discussions, communications, or agreements concerning the same subject matter. A separate signed pilot, enterprise, research, confidentiality, or subscription agreement may supplement these Terms; if that agreement expressly conflicts with these Terms, the separate signed agreement controls for the subject of the conflict.
